The Work and Families (Northern Ireland) Act 2015 and associated regulations provide an opportunity for parents to take advantage of additional flexibility in the way they choose to care for a new arrival to the family.

Eligible employees of babies due to be born or placed for adoption from April 2015 will have a new statutory entitlement to shared parental leave and pay. This technical guidance is for employers who think their employee(s) may be eligible.
SPL is a legal entitlement for eligible parents of babies due, or children placed for adoption, on or after 5 April 2015.
A surrogate parent may be eligible to Statutory Adoption Leave and Pay from 5 April 2015, provided that:
The Maternity and Parental Leave Regulations (Northern Ireland) 1999 introduced a right to Parental Leave for parents of any child under the age of 18.
Pregnant employees are entitled to up to one year’s maternity leave. Paternity leave is available if certain criteria are met. Parents are also entitled to 18 weeks’ unpaid leave for each child up to their 18th birthday.
From April 2019 Statutory Shared Parental Pay will paid at £151.20 per week (April 2020) or 90% of average weekly earnings (whichever is lower).
These Regulations come into operation on 15/3/15 and by way of summary the Shared Parental Leave Regulations (Northern Ireland) 2015 (“the Leave Regulations”), in association with the Statutory Shared Parental Pay (General) Regulations (Northern Ireland) 2015 (“the Pay Regulations”) provide an entitlement for a mother/adopter and a child’s father/adoptive parent or a mother’s or adopter’s partner to take shared parental leave and pay.
