No. 141 The Disability Discrimination (Guidance On The Definition Of A Disability) (Appointed Day) Order (Northern Ireland) 2008
This Order appoints 21/4/08 as the day for the coming into operation of new guidance entitled “Guidance to be taken into account when determining questions in relation to the definition of disability” as issued in Northern Ireland by OFMDFM.
This Order stipulates 30th May 1996 as the day in which various components of the 1995 Act come into operation including issues such as: definition of disability, past disabilities, guidance, definitions of lease/sub-lease/sub-tenancy, advice and assistance, statutory authority, national security, restrictions on publicity in Industrial Tribunals, interpretation, supplementary provisions and so on.
These Regulations provide for the established definition of a disability for the purposes of the 1995 Act, that is, a physical or mental impairment which has a substantial and long term adverse effect on the person’s ability to carry out normal day to day activities.
440 The Disability Discrimination (Description of Insurance Services) Regulations (Northern Ireland) 1999
These Regulations make disability discrimination by an insurer against an employee unlawful as according to S.18 of the Disability Discrimination Act (1995).
404 The Disability Discrimination Code of Practice (Duties of Trade Organisations to their disabled members and applicants) (Appointed Day) Order (Northern Ireland) 1999
The appointed day for the commencement of this Code is 1/10/99 and as such enacts sections 13-15 of the Disability Discrimination Act 1995.
These Regulations provide for circumstances whereupon treatment of a disabled employee or failure to make a reasonable adjustment is justified: where pay is linked to performance, where there are uniform rates of contribution to an occupational pension scheme regardless of benefits received, where building works complied with (and continue to comply with) the building regulations in relations to disabled access and facilities.
549 Disability Discrimination (Guidance on Code of Practice) (Appointed day) Order (Northern Ireland) 1996
This Order stipulates 2nd December 1996 as the date on which this guidance comes into force and addresses the elimination of discrimination in the field of employment against disabled persons or persons who have had a disability.
This Order brings into operation aspects of the Disability Discrimination Act 1995 relating to taxi drivers (taking guide dogs/hearing dogs), Departmental papers regarding exception applications and appeals.
These Regulations address many issues including the following matter: ‘justified’ treatment, insurance, premises, deposit refunds, entering agreements where the disabled person is acting through an agent.
No. 439 (C.22) The Disability Discrimination Act 1995 (commencement No.8) Order (Northern Ireland) 2001
This Order provides for certain powers and interpretation matters contained in S.27 and Schedule 4 of the Disability Discrimination Act (1996) eg – reasonable adjustments by service provides, alterations to leased premises and so on.
