Under Article 54A of the Disability Discrimination Act 1995, the Equality Commission for Northern Ireland may prepare and issue codes of practice giving practical guidance: to - employers, service providers; to - promote equality of opportunity, encourage good practice in the field of employment and in access to goods, facilities services and premises. No. 206 The Labour Relations Agency (Flexible Working) Arbitration Scheme Order (Northern Ireland) 2006
This Order establishes and brings into operation the flexible Working Arbitration Scheme as facilitated by the Labour Relations Agency.
This order amends the 1995 Order of the same name by clarifying that awards calculated by the Tribunal on which interest is calculated does not include an award in respect of costs, allowances of preparation time. The Order also stipulates the Tribunals’ power to deal with complaints of harassment in this context.
280 (13) The Disability Discrimination Act 1995 (Commencement No. 3 and Saving and Transitional Provisions) Order (Northern Ireland) 1996
This Order stipulates 11th July 1996 as the day in which further components of the 1995 Act come into operation of a Code of Practice relating to help for persons suffering discrimination, and on 2nd December 1996 provides for: discrimination against applicants and employees, meaning of discrimination, duty of employer to make adjustments, small business exemption, enforcement, remedies, discriminatory adverts, discrimination against contract workers, discrimination by trade organisations (as defined), alterations to premises under lease, discrimination in relation to goods, facilities and services, small dwelling exemptions, victimisation, aiding unlawful acts, liability of employers and so on.
These Regulations deal with eligibility, applications, breaches of procedure and compensation in relation to statutory applications for contract variation to allow flexible working under the Employment Rights (Northern Ireland) Order 1996 - (See Article 112f)
These Regulations amend the Working Time Regulations (1998) with regard to – leave (4 weeks), removal of the 13 week qualification rule and the ‘accrual’ of leave in the first year of employment.
These Regulations amend the Working Time Regulations by continuing to phase in the reduction in the maximum number of hours (subject to individual opt out) that doctors in training are required to work.
