Arbitration Scheme For Resolution Of Unfair Dismissal Disputes
In the case of an alleged unfair dismissal both parties may agree to refer the case to an arbitration hearing using The Labour Relations Agency Arbitration Scheme for the Resolution of Unfair Dismissal Disputes.
The scheme is an alternative means of resolving disputes relating to unfair dismissal only. Parties to an unfair dismissal case who agree to use the arbitration scheme waive their rights to take their case to a tribunal. A panel of arbitrators has been appointed by the Agency specifically to hear cases of alleged unfair dismissal. The scheme is intended to be faster and cheaper than the tribunal system and is non legalistic, with no cross examination of parties to the dispute or of witnesses by legal representatives.
