5 (C.1) Employment Relations (1999 Order) (Commencement No.2 and Transitional Provision) Order (Northern Ireland) 2000

This Order brings into operation on 2/2/00 the provisions of the Employment Relations Order 1999 as specified in Article 2 which relate to the “up rating” of certain awards of Industrial Tribunals and other sums payable under employment legislation. The Order Also makes provision for the coming into operation of related appeals.

6 Employment Rights (Increase of Limits) Order (Northern Ireland) 2000

This Order increases, as from 5/3/00, the limits applying to certain awards of industrial tribunals, and other amounts payable under employment legislation, as specified in the Schedule to the Order. (Increases reflect increases in Retail Price Index from Sept’97-Sept’99).

7 Working Time (Amendment) Regulations (Northern Ireland) 2000

These Regulations further amend the Working Time Regulations (Northern Ireland) 1998 (as amended). The amendments relate to provisions linked with the maximum weekly working time average of 48 hours (re: up to date records, opt out agreement in writing, unmeasured working time determination, and guidance publications requirements on the Department for Employment and Learning).

8 Equal Opportunities (Employment Legislation) (Territorial Limits) Regulations (Northern Ireland) 2000

These Regulations relate to the “posting” of workers in terms of equality of treatment between men and women and other provisions on non-discrimination are extended to said postal workers. (Workers who, for a limited period, carry out work in another Member State). These Regulations extend the application of the relevant provisions to workers by removing the words ‘or mainly’ from the existing legislation (ie) – wholly or mainly outside Northern Ireland in relation to territorial limits.

This Order corrects an error in the Employment Rights (Increase of Limits) Order (Northern Ireland) 2000 regarding the relevant figure limits.

122 (C.4) Employment Relations (1999 Order) (Commencement No.3 and Transitional Provision) Order (Northern Ireland) 2000

This Order brings into operation, on 24/4/00, Article 18 and Schedule 5 of the Employment Relations (NI) Order 1999 relating to unfair dismissal in certain circumstances within the context of official industrial action (started on or after 24/4/00). There are also consequential amendments relating to unfair selection for redundancy.

This Order brings into Operation on 25/4/00 certain provisions of Part 2 of the Equality (Disability, etc) (Northern Ireland) Order 2000 which relate to the powers and duties of the Equality Commission in respect of discrimination by reason of disability.

192 (C.9) Employment Rights (Time off for Study and Training) (1998 Order)(Commencement) Order (Northern Ireland) 2000

This Order brings into operation on 1/9/00 the provisions of the Employment Rights (Time off for study or training) (Northern Ireland) Order 1998. It provides a right for certain young workers to time off to study or train for qualifications.

193 Employment Rights (Time off for Study or Training) Regulations (Northern Ireland) 2000

These Regulations set out the standard of achievement which is prescribed for the purposes of the Employment Rights (Northern (Ireland) Order 1996. An employee who has not attained the standard of achievement has the right to take time off for study or training leading to the relevant qualification.

199 Fair Employment (Specification of Public Authorities) Order (Northern Ireland) 2000

This Order revokes and replaces the 1989 Order of the same name by specifying a number of persons or bodies as public authorities for certain purposes under Part VII of the Fair Employment and Treatment (Northern Ireland) Order 1998.

219 Part-time Workers (Prevention of Less Favourable Treatment) Regulations (Northern Ireland) 2000

These Regulations came into operation on 1/7/00 and implement Directive 97/81/EC. The Regulations give part-time workers the right in principle not to be treated less favourably than full-time workers of the same employer who work under the same type of employment contract. A right is also given to workers who become part-time, or having been full-time return part-time, to be treated not less favourably than they were before going part-time. The Regulations also make provision for objective justification and provide for related rights to be exercised by complaint to an Industrial Tribunal.

228 Fair Employment (Monitoring) (Amendment) Regulations (Northern Ireland) 2000

These Regulations amend the 1999 Regulations of the same name which amongst other things require employers to provide certain information about the composition of their workforce in monitoring returns. The Regulations also address provisions regarding promotees and apprentices.

These Regulations amend the 1996 Regulations of the same name in relation to the amount of information to be placed by the Secretary in the Register in relation to applications and appeals.

262 The Stakeholder Pension Schemes Regulations (Northern Ireland) 2000

These Regulations came into effect on 1/10/00 and make provisions for, amongst other things, conditions applying to stakeholder pension schemes, registration of stakeholder pension schemes, employer requirements, amendments and schedules.

324 The Statutory Maternity Pay (General) (Modification and Amendment) Regulations (Northern Ireland) 2000

These Regulations modify the Social Security Contributions and Benefits (Northern Ireland) Act 1992 as it relates to conditions of entitlement to statutory maternity pay and further amends the Statutory Maternity Pay (General) Regulations (Northern Ireland) 1987. Other parts of the Regulations address modifications made in relation to certain women who are dismissed.

371 Fair Employment (Specification of Public Authorities) (No.2) Order (Northern Ireland) 2000

This Order specifies a number of persons or bodies as public authorities for certain purposes under Part VII of the Fair Employment and Treatment Order (Northern Ireland) 1998 and provides for the persons who are to be treated for such purposes as employees of same of these authorities.

373 (C.17) Employment Relations (1999 Order) (Commencement No. 4 and Transitional Provisions) Order 2000

This Order brings into operating, on 8/3/01, Articles 3,7,8 and 25 and Schedule 1 of the Employment Relations (Northern Ireland) Order 1999. The provisions make amendments to the Industrial Relations (NI) Order 1992, the Trade Union and Labour Relations (NI) Order 1995 and the Employment Rights (NI) Order 1996. The provisions relate to the right of trade unions to be recognised in certain circumstances to conduct collective bargaining on behalf of workers as well as other transitional matters relating to detriment and dismissal.
