4 Race Relations (Prescribed Public Bodies) Regulations (Northern Ireland) 1998

These Regulations prescribe certain public bodies under and for the purposes of Article 71 (5) of the Race Relations (Northern Ireland) Order 1997 relating to employment rules relevant to service of the Crown or certain public bodies.

62 The Statutory Maternity Pay (Compensation of Employers) (Amendment) Regulations (Northern Ireland) 1998


These Regulations amend the 1994 Regulations of the same name and relate to employer recovery payments in terms of amendments and increases.

78 Employer’s Liability (Compulsory Insurance) Exemption Regulations (Northern Ireland) 1998


These Regulations revoke and re-enact (with some changes) the 1975 Regulations of the same name, along with associated Regulations. The Regulations, amongst other things detail exempt employers and provide an accompanying list.

This Order (1 April 1998) defines the limits of certain industrial awards, for example, ‘capped’ weeks pay £220, unfair dismissal compensatory award limit £12,000.

This Order brings into operation as of 13th May 1998 further components of the 1995 Act in relation to rail vehicle access, exemptions from rail vehicle access and offences related thereof.

231 Sex Discrimination Code of Practice (Recruitment and Selection) (Appointed day) Order (Northern Ireland) 1998

The Code of Practice for removing sex bias from recruitment and selection comes into effect on 3rd August 1998 and the Code can be admitted in evidence to County Court or Industrial Tribunal if deemed relevant to any question in proceedings.

242 Suspension from Work on Maternity Grounds (Merchant Shipping and Fishery Vessels) Order (Northern Ireland) 1998

These Regulations require that in certain circumstances new or expectant mothers shall be suspended from work for health and safety reasons. There are cross reference provisions to Employment Rights (Northern Ireland) Order 1996 relating to: offering alternative work, paid suspension and so on.

This Order brings into operation various aspects of the 1998 Order including Schedules 1, 2 and 3 at the respective times of 8th August 1998, 1st October 1998 and 1st January 1999.

280 Code of Practice (Picketing) (Appointed day) Order (Northern Ireland) 1998

This Order stipulates 1st September 1998 as the date whereupon the Code comes into effect. The Code can be admitted into Court, Industrial Court and Industrial Tribunal proceedings if it is relevant to any question arising.

287 Code of Practice (Redundancy Consultation and Procedures) (Appointed
Day) Order (Northern Ireland) 1998

This Order stipulates 1st October 1998 as the date thereupon the Code comes into effect. The Code is issued by the Labour Relations Agency under Article 90 of the Industrial Relations (Northern Ireland) Order 1992. (The Code revises and replaces the earlier Code (1993)). The Code can be admitted into Industrial Court or Industrial Tribunal proceedings if it is relevant to any question arising.

386 Working Time Regulations (Northern Ireland) 1998

The Regulations implement a European Directive relevant to working time which cover an array of matters including the following: maximum average weekly working time, average normal hours of night workers, health assessments for night workers, rest breaks, records, weekly rest, paid annual leave, exemptions, right to take a claim to Industrial Tribunals and so on.

391 Disability Discrimination (Exemption for Small Employers) Order (Northern Ireland) 1998

This Order lowers the small employer exemption threshold (available under Section 7 (1)) from 20 employees to 15 employees.

422 Working Time (Amendment) Regulations (Northern Ireland) 1998

These Regulations serve to amend an error in the 1998 Regulations relating to calculations of working time, including overtime, in any reference period applicable shall not exceed 48 hours for each 7 days. There is a provision in the 1998 Regulations for a worker to agree that the limit should not apply to him.

424 Fair Employment (Specification of Public Authorities) (Amendment) Order (Northern Ireland) 1998

This Order amends the 1989 Order of the same name which specifies a number of persons or bodies as public authorities for certain purposes under the Fair Employment (Northern Ireland) Act 1989 and provides for persons who are to be treated for such purposes as employees of some of these authorities (see Schedules).
